The University Rathskeller, Inc. is a corporation created under the laws of the State of Florida. Its licenses to operate include those from the City of Coral Gables and the State Division of Alcoholic Beverages and Tobacco. The terms of the Rathskeller licenses require compliance with all pertinent laws and with University policies and regulations.

Persons using the University Rathskeller facilities are bound by all State and local laws and ordinances. A violation of any applicable public law or ordinance is also a violation of the University rules and regulations under this section; and will result in University disciplinary action and/or prosecution by civil authorities.
For illustrative purposes the following is a partial list of the types of conduct which could result in University disciplinary action:
Whenever it comes to the attention of the University Rathskeller Manager or his/her designee that a violation of any pertinent state or city law, ordinance, regulation or University policy has occurred, shall immediately exclude that violator, and his/her host if the violator is a guest, and those who may have contributed to that violation, from the physical bounds of the University Rathskeller. The exclusion shall be for the remainder of the date when the violation occurred or it shall be binding until the Office of the Dean of Students can handle the violation, in accordance with University of Miami disciplinary procedures. The exclusions shall be permanent upon the commission of a second violation or entry into the Rathskeller during the period of the original exclusion.
The Office of the Dean of Students will be notified of alleged Rathskeller violations. When appropriate, disciplinary action will be taken in accordance with existing University of Miami disciplinary procedures.
Appeals from University disciplinary action resultant from violations of Rathskeller policies and procedures shall be heard by the appropriate University administrative authorities.
The Manager of the Rathskeller or his/her designee acting in place of the Manager shall have the sole authority to determine, in his/her judgment, whether persons are intoxicated or are becoming intoxicated, and to take disciplinary action against such persons in accordance with these Rathskeller policies and procedures.
Control efforts will be employed to preclude a patron from becoming intoxicated. However, if in the judgment of the Manager or his/her designees a patron becomes intoxicated, the Manager or his/her designees shall take such action as may be proper under the circumstances with regard for the safety and well being of the intoxicated individual, and other persons and property. Such action may include the referral of this individual for arrest and prosecution by legal authorities.
Service animals as outlined by the Americans with Disabilities Act (ADA) are permitted indoors, and both service and emotional support animals are permitted on the outdoor patio. If an animal becomes a disturbance toward the staff and/or other customers, as determined by the Manager of the Rathskeller or his/her designee, they will have the right to refuse service and require the animal to leave the premises.
From time to time the Rathskeller Manager, with the approval of the Rathskeller Board of Directors, may deem it advisable to initiate and implement new policies and procedures. Rathskeller members will be given reasonable notice of any new policies and procedures that may be adopted.
